President Donald Trump is seeking nearly $800,000 from Stormy Daniels — $390,000 in legal fees and equal amount as a deterrent against a “repeat filer of frivolous defamation cases.”
Trump’s attorneys are arguing that what Daniels did is unprecedented — and that it requires a unique response.
“This action is virtually unprecedented in American legal history,” Trump’s attorney Charles Harder said in a court filing on Monday. He asserted that Daniels “not only brought a meritless claim for defamation against the sitting president of the United States, but she also has engaged, along with her attorney, in massive national publicity.”
Creepy Porn Lawyer Michael Avenatti, who represents Daniels, has called the claim “absurd and outrageous.”
“You can’t just pick a number out of thin air in an effort to put my client under Donald Trump’s thumb and intimidate her,” Avenatti said, according to the Associated Press.
The judge in the case, Judge S. James Otero, has said that the lawyer’s fees are reasonable, but that the hours spent on the case may have been excessive. He has not indicated which way he will rule on the additional deterrent penalty.
